1. Accepting These Terms

By using Minty Digit, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you may not use our services.

2. Our Services

Minty Digit is an online platform based in Vadodara, Gujarat, India. All products are currently created, owned, and sold directly by Minty Digit.

(Future: If Minty Digit allows independent sellers/artists, additional Seller & Artist Terms will apply. See Section 11.)

3. Eligibility

You must be at least 18 years old to make a purchase. If you are under 18, you may only use Minty Digit with the involvement of a parent or guardian.

4. Buyer Terms

• All purchases are subject to availability and confirmation of payment.
• Prices are displayed in INR for Indian buyers and include applicable taxes (GST, if applicable).
• International buyers: Prices will apply as per the currency and country of purchase and may include customs duties, import taxes, or other levies. Such charges shall be borne by the buyer.
• Provide accurate delivery details; Minty Digit is not liable for failed deliveries due to incorrect or incomplete information.
• Refunds, returns, and cancellations will be processed as per our Refund & Cancellation Policy.

5. Intellectual Property

All artworks, designs, logos, images, and content on Minty Digit are the exclusive property of Minty Digit and protected under Indian copyright and trademark law.

Purchasing a product does not grant you rights to copy, reproduce, resell, distribute, or commercially exploit our designs or artworks.

Unauthorized commercial use, duplication, or reproduction of our intellectual property is strictly prohibited and may result in legal action.

6. Prohibited Use

• Use Minty Digit only for lawful purposes under Indian law.
• Do not copy, reproduce, resell, or distribute designs, artworks, or products for commercial purposes.
• Do not attempt to disrupt, damage, hack, or interfere with the website.
• Do not send spam, offensive messages, or attempt to bypass official transactions.

7. Limitation of Liability

All products are provided “as is” unless otherwise required by law. Minty Digit is not liable for indirect, incidental, or consequential damages, including loss of data or files.

Minty Digit is not responsible for failed downloads caused by user device incompatibility, internet issues, or third-party platform errors.

8. Indemnity

You agree to indemnify and hold harmless Minty Digit, its owners, and employees against any claims, damages, or expenses resulting from your misuse of our services or violation of these Terms.

9. Dispute Resolution and Governing Law

These Terms are governed by Indian law. Any disputes shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat.

10. Termination

We may suspend or terminate your access if you violate these Terms.

11. Future Seller and Artist Rules (Reserved)

• Ownership of Content: Sellers retain rights but grant Minty Digit a license to display and promote their work.
• Responsibility: Sellers are responsible for the quality, legality, and customer service of their products.
• Compliance: Sellers must comply with Indian consumer protection, GST, and intellectual property laws.
• Dispute Handling: Minty Digit may mediate disputes, but final responsibility lies with the seller.

12. Changes to Terms

We may update these Terms from time to time. Continued use of Minty Digit constitutes acceptance of updated Terms.

13. Harassment, Abuse, and Misuse

• Harassment, abusive language, threats, stalking, or discrimination towards Minty Digit or its staff is prohibited.
• Serious violations may be reported to law enforcement under the IT Act, 2000 and relevant sections of the IPC.
• Users must not attempt to hack, scrape, or reverse-engineer the website or files.

14. Refund & Cancellation Policy for Digital Downloads

• All products are digital downloads; no physical items are shipped.
• All sales are final once the download is complete.
• Refunds are only issued if a payment error occurred (e.g., duplicate charge) or the file failed to deliver due to technical issues.
• Technical issues must be reported within 48 hours for assistance.
• International buyers are responsible for applicable taxes, customs duties, or import fees.

15. Data Privacy

By using Minty Digit, you consent to the collection and use of your data as described in our Privacy Policy.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
